ChatbotCard Terms of Service

Effective Date: August 2, 2026

These Terms of Service ("Terms") govern your access to and use of the ChatbotCard platform, website, software, AI services, NFC products, QR code services, digital business cards, mobile experiences, and related services ("Services") provided by Nyla Technologies LLC.

1. Acceptance of Terms

By accessing or using the Services, creating an account, activating a ChatbotCard, purchasing products, or using any feature of the platform, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility

You represent that you are at least 18 years old or have legal authority to enter into this agreement.

3. Description of Services

AI-powered business cards
NFC and QR code products
Digital business cards
AI assistants and knowledge bases
Lead capture and appointment scheduling
Media hosting and customer engagement tools
Subscription services and related software

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

5. AI Services

AI responses are generated using information you provide and third-party AI technologies. Responses may be incomplete or inaccurate and are provided for informational purposes only. You are responsible for reviewing AI-generated content before relying upon or distributing it.

6. User Content

You retain ownership of content you upload, including documents, PDFs, logos, images, videos, and knowledge bases. By uploading content you grant Nyla Technologies LLC a non-exclusive license to host, process, display, and transmit that content solely for operating the Services.

7. Prohibited Uses

Illegal activity
Spam or phishing
Malware distribution
Copyright infringement
Unauthorized access attempts
Uploading content you do not have permission to use
Misuse of AI or automated abuse of the platform

8. Hardware

NFC cards, stickers, and related products are subject to availability. Device compatibility varies by manufacturer and operating system. QR codes remain available where NFC is unsupported.

9. Payments & Subscriptions

Payments are processed by third-party providers. Subscription plans renew according to the selected billing cycle unless cancelled. Fees are generally non-refundable except where required by applicable law.

10. Intellectual Property

All ChatbotCard software, branding, source code, designs, trademarks, and website content remain the exclusive property of Nyla Technologies LLC unless otherwise indicated.

11. Privacy

Your use of the Services is also governed by the ChatbotCard Privacy Policy.

12. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, to the fullest extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by law, Nyla Technologies LLC shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, business interruption, or loss of goodwill. Total liability shall not exceed the amount paid by you to the Company during the twelve (12) months preceding the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless Nyla Technologies LLC from claims arising from your use of the Services, uploaded content, or violation of these Terms.

15. Suspension & Termination

We may suspend or terminate accounts that violate these Terms, misuse the platform, engage in fraud, or create security risks.

16. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

17. Changes

We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
